General Terms of Use

In these Terms, the following terms have the following meanings:

• Cutz: the platform available at getcutz.ch and its operators, Matteo Cobos and Tyméo Picchio, associated as a simple partnership (société simple) not entered in the commercial register, Chemin du Coteau 27, 1422 Grandson, Switzerland
• Client: any natural person using the platform to search for and book a hairdresser
• Partner hairdresser: any professional or hair salon registered on the platform to offer their services
• Service: any hairdressing service booked through the platform
• Booking: the confirmation of a time slot between a client and a partner hairdresser

Cutz is a platform that connects clients with hairdressing professionals in Switzerland. Cutz does not employ the partner hairdressers and is not a party to the service contract concluded between the client and the hairdresser.

Cutz provides: (i) a search and booking interface, (ii) the sending of confirmations, reminders and cancellation notices, (iii) management tools for salons, the scope of which depends on the plan chosen: calendar, client records, waiting list, accounting and salon website.

Cutz does not process any payment between the client and the partner hairdresser.

Use of Cutz is open to any natural person who is of age (18 years completed), or who is a minor with the consent of a legal representative, and who has a valid email address.

Booking is possible without creating an account. In that case, a guest account is opened with the contact details provided, in order to send the confirmation and allow cancellation.

Each user is responsible for keeping their login credentials confidential. Any access to the platform with your credentials is deemed to have been made by you. If your account is compromised, you must contact Cutz immediately at contact@getcutz.ch.

Cutz reserves the right to suspend or delete an account in the event of a breach of these Terms or of fraudulent or abusive conduct.

Every booking made through Cutz constitutes a firm commitment between the client and the partner hairdresser. It is confirmed immediately, without approval by the hairdresser, and the client receives the confirmation by email.

By making a booking, the client accepts:

• The prices shown on the hairdresser’s profile
• The cancellation conditions set out in Article 6
• The obligation to attend the booked time slot

Cutz does not guarantee the availability of any particular hairdresser. The time slots displayed reflect the availability declared in real time by the hairdressers.

Payment is made directly at the salon according to the hairdresser’s terms (cash, card, etc.). Cutz does not process payments between clients and hairdressers.

The hairdressers’ monthly subscription is processed by Stripe, Inc. (PCI DSS certified). Cutz does not store any payment card data.

As payment is made directly at the salon, Cutz neither charges nor refunds any cancellation fee. Cancellation is possible online up to 24 hours before the appointment; after that, it is governed by each hairdresser’s own conditions:

The client is encouraged to cancel as early as possible, using the link received by email or from their personal area. Once the 24-hour deadline has passed, the client contacts the hairdresser directly.

The hairdresser may cancel an appointment. The client is notified by email and owes nothing. In the event of repeated cancellations by a hairdresser, Cutz reserves the right to suspend their profile.

After a past appointment, the client may leave a rating. It is published on the salon’s page together with the client’s first name. The review request email is only sent if the salon has confirmed that the client attended. These reviews are subject to the following rules:

• Only clients who actually booked and received the service may leave a rating
• Reviews must be honest and based on actual experience
• Any defamatory, abusive or false content will be removed
• Cutz reserves the right to moderate reviews without informing the author beforehand

Cutz acts as a technical intermediary. The contractual relationship for the hairdressing service is established directly between the client and the partner hairdresser.

Cutz cannot be held liable for:

• The quality of the services provided by partner hairdressers
• Any damage occurring during a service
• Temporary unavailability of the platform

In the event of a dispute with a hairdresser, we encourage you to contact the hairdresser directly first, and then contact@getcutz.ch if necessary.

Registration as a partner hairdresser is open to any hairdressing professional working in Switzerland. The profile is made public after verification by Cutz. It benefits from the trial period from registration; continuing the service beyond the trial requires an active subscription.

By registering, the hairdresser certifies on their honour:

• That the information provided (name, address, contact details) is accurate
• That they carry on their business lawfully and in compliance with Swiss legislation
• That they hold the authorisations required to practise hairdressing

Cutz reserves the right to suspend or delete any profile containing inaccurate or fraudulent information.

By registering on Cutz, the partner hairdresser undertakes to:

• Carry on their business in full compliance with applicable Swiss legislation
• Hold the insurance required to carry on their professional activity
• Honour confirmed bookings, or cancel them while notifying the client as early as possible
• Keep their availability up to date on the platform
• Treat clients professionally and with respect
• Only activate visit reminders for clients who have agreed to them
• Comply with their tax and social security obligations

Partner hairdressers set their prices freely. Payment is made directly between the client and the hairdresser at the time of the service. Cutz does not take any commission on the services performed.

Cutz’s remuneration comes exclusively from the monthly subscription paid by the hairdressers (Article 12).

Partner hairdressers choose a monthly subscription plan. The prices and features currently offered are detailed on the pricing page and shown again before subscribing.

The subscription renews automatically every month. The plan can be changed at any time: Stripe calculates the difference pro rata on the next invoice. The subscription can be terminated at any time from the dashboard, with effect at the end of the current period.

Any price change is notified to the hairdresser before it applies to their subscription.

Partner hairdressers carry on their business in their own name, as self-employed persons or through their company. They are not employees, agents or representatives of Cutz. No relationship of subordination exists.

Each partner hairdresser is solely responsible for their tax and social security obligations (OASI/AHV, taxes, VAT where applicable) and must hold their own professional liability insurance.

The clients’ personal data accessible to the hairdresser (first name, surname, email, telephone) may only be used within the scope of the hairdresser’s relationship with the client. The hairdresser shall not transfer them to third parties and undertakes to comply with the FADP.

For their client records, notes, imports and accounting, the partner hairdresser is the controller. Cutz acts as a processor: it hosts and processes this data solely on the hairdresser’s behalf, protects it with appropriate security measures and does not use it for any other purpose. Details are set out in the privacy policy.

Any breach of these obligations may result in the immediate termination of the account without compensation.

Cutz may terminate a hairdresser account with immediate effect in the event of a breach of the Terms, fraudulent conduct, false information, repeated failure to honour bookings or unlawful activity.

The hairdresser may terminate at any time from their dashboard or by contacting contact@getcutz.ch.

By uploading photos to their profile, partner hairdressers grant Cutz a non-exclusive, worldwide and royalty-free licence to display these images on the public salon page and the salon website.

The hairdresser warrants that they hold the rights to the published photos and that these do not infringe any third-party rights. Cutz claims no ownership of this content and will delete it upon simple request when the account is terminated.

The content of the Cutz platform (logo, design, texts, code) is protected by copyright. Any reproduction without written permission is prohibited.

In accordance with the Federal Act on Data Protection (FADP), every user has the following rights over their personal data:

• Right of access: obtain a list of the personal data that Cutz holds about you
• Right to rectification: correct inaccurate or incomplete data
• Right to erasure: request the deletion of your account and your data
• Right to data portability: receive your data in a readable format

From a client account, export and deletion are done directly in the “My data” section. For any other request, contact contact@getcutz.ch. Cutz responds within 30 days. Details of the processing are set out in the privacy policy.

These Terms are governed by Swiss law, in particular the Swiss Code of Obligations (CO) and the Federal Act on Data Protection (FADP). The place of jurisdiction is Grandson (Canton of Vaud), the seat of Cutz, subject to the mandatory places of jurisdiction provided for by law, in particular the place of jurisdiction at the consumer’s domicile.

Cutz reserves the right to amend these Terms at any time, in particular to adapt to changes in the platform or in legal requirements.

Users will be informed of any material change by email or via a notification on the platform at least 15 days before the entry into force of the new terms.

Continued use of the platform after this period constitutes acceptance of the amended Terms. If they disagree, users may terminate their account before the changes enter into force.
